Indemnification Policy

You agree to use all Host4Fans services and facilities at your own risk. Host4Fans specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Host4Fans be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. Customer agrees that it shall defend, indemnify, save and hold Host4Fans harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Host4Fans, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Host4Fans against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with Host4Fans's server.

Host4Fans reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement anydefective products sold to customer from Host4Fans's server. Host4Fans shall be the sole judge of what violates this Policy.


At this time we bill monthly, quarterly, semi-annually and annually, depending upon the plan. If you are not satisfied within your first 30 days we would be happy to provide you with a full refund.

In all paid plans we will setup your account after the invoice is paid. Clients are encouraged to pay by PayPal as it is the easiest way to handle payment at this time. There are no contract periods,you will need to pay everytime your payment cycle ends, to make it easier you can subscribe through PayPal so the money will be taken directly of your account. Please note, after service cancellation you have to cancel automatic renewal payment in your PayPal account. Late Payments:

All accounts are billed according to the dates they were first activated on. If the payment is not completed before the expiration date, your account will get deactivated/suspended. If you will not pay for service renew in 10 (without prior notice) days after deactivation , your account will be terminated.

Acceptable Use Policy:

All services provided by Host4Fans may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limitedto: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Host4Fans and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all Host4Fans servers. This includes sites that include sexually explicit or hardcore images and/or advertising.

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.

Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.

Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.

Banned Scripts / Should not be used:

The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.
IRC/IRC egg drops
Proxy servers
Mail bombers
Anonymous mailers
IP spoofers
Port scanners
Telnet or SSH Access Scripts
nph-proxy (and other scripts what operates like proxy)
UBB (Ultimate Bulletin Board, all versions)
FormMail.cgi, FormMail.pl from Matt's Script Archive are not allowed.
Any Ilegal Activity

Unlimited Disk Space:

We do not set limits on the amount of disk space provided with our shared hosting and reseller hosting plan. We believe our clients should have all the resources necessary to build a great online presence and 99.95% of customers will have more than enough disk space and bandwidth to meet their needs. Please note that providing free hosting, running a image hosting portal or any other file hosting portal, Large Disk websites may cause that we contact you to upgrade to a VPS package! We will NEVER suspend your account without a notice like some other hosts do!


You agree to take full responsibility for data hosted on your account and to maintain backup of data that you host on Host4Fans's servers. While Host4Fans does maintain backups of your data and provide a JetBackup plugin in cPanel for convenient access to the backed up data, they are not meant to replace your own backups as the JetBackup backups we carry out are solely meant for administrative purposes in the event of a disaster recovery. There is no single backup system that is not susceptible to failures and although we are using some of the best measures in the industry such as implementation of Hardware RAID-10 on all of our servers and having Host4Fans Remote Backup (Weekly Backups - Retained for a month) in place, we cannot accept any responsibility should backups be unavailable for any reason including but not limited to software issue, data corruption and hardware failure. We strongly recommend and encourage clients to maintain their own regular backups onto their own computers.


Host4Fans offers free Migration services as a courtesy with our cPanel hosting services. Host4Fans offers its migration services in an as-is basis and makes no guarantess or time commitments at all. We will do our best, however, in some causes we may be unable to assist you in a transfer from other host.

DDoS Protection:

Host4Fans offers a free Unlimited DDoS Protection to all Clients. If for any reason your Project attracts daily DDoS attacks, we have the right to disable your account and to ask you for a report that what you are hosting that you attract the large number ofthe attacks. We will enable again your account if you provide us with informations regarding the attacks. If you ignore our mails/tickets, your account will be disabled until you answer our questions.


Host4Fans shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Host4Fans servers going off-line or being unavailable for any reason whatsoever. Furthermore, Host4Fans shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Host4Fans servers. All damages shall be limited to the immediate termination of service.


Host4Fans cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Host4Fans are resold. Thus, certain equipment, routing, software, and programming used by Host4Fans are not directly owned or written by Host4Fans. Moreover, Host4Fans holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed,the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Host4Fans sees fit. FURTHERMORE, Host4Fans retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.

Money Back Guarantee:

If an account with a 30 day money-back guarantee is purchased and cancelled within 30 days of sign up, the Customer will, upon request, receive a full refund of all hosting fees. Requests for these refunds should be made through our Billing Team. Refunds made for a 30 day money-back guarantee will not include setup fees, or any fees for additional services that are purchased in the first 30 days - including funds. The Money Back Guarantee applies to new clients only. Spammers, Hackers and other clients that try to do illegal things will not be refunded. The refund would be made within the first ten days of the following month if it was requested after the first 10 days of current month.

Only first-time accounts are eligible for a refund. What this means is if you had signed up with us for more than 30 Days or if you had requested for a refund before, then you will not be eligible for a refund.

Uptime Guarantee:

Host4Fans strives to maintain a 99.9% network and server uptime service level. This uptime percentage is a monthly figure, and is calculated solely by Host4Fans monitoring systems or Host4Fans authorized/contracted outside monitoring services. If Host4Fans fails to meet its 99.9% uptime guarantee, and it is not due to one of the exceptions below, credits will be made available to each client, upon request, on a case by case basis. Host4Fans does not credit a full month's service for minor downtime. This would not be financially healthy for Host4Fans, and in turn would only negatively affect the service level Host4Fans provides to you. "Partial refunds for partial downtime" is our standard policy. In extreme circumstances, Host4Fans may distribute full month credits, but this is dealt with on a case by case basis. Credits are issued for one month service only, never more. You must request a refund within the first seven days since the downtime or communicate was released.
- Exceptions:
1) Any scheduled downtime or planned maintenance is except from this guarantee.
2) Clients currently in arrears for services do not qualify for SLA claims.
3) Clients participating in malicious activities, thereby causing attacks or counterattacks, do not qualify for SLA claims.
4) Downtime occuring due to natural disasters or DDoS attacks against the network do not count towards the SLA calculations.
5) Hardware or Software failures.
